Baby on Nirvana’s Nevermind album cover sues over child exploitation

The suit comes 30 years after the album’s release.

The man whose baby photo was featured as Nirvana’s Nevermind album cover is now suing the band for child sexual exploitation.

Spencer Elden, now 30, claims he is the naked baby pictured in a swimming pool on the 1991 album artwork – and that the image is child based sexual abuse.

According to documents obtained by TMZ, a new federal lawsuit initiated by Elden claims he could not consent to the use of his image on the album art thirty years ago as he was only four months old.

He also claims his legal guardians didn’t consent on his behalf.

The documents allege the band promised to cover his genitals with a sticker for the album cover but never followed through.

As a result, he claims the band failed to protect him from sexual exploitation, and that having his naked image on a famous album circulated everywhere caused him to suffer lifelong damages.

Elden is suing the band’s surviving members, Kurt Cobain’s estate and others for damages of around $150,000 each.

Reps for Nirvana and Cobain’s estate have yet to comment on the lawsuit.
