For the first time in history, a mother is trying to gain access to her dead daughter's frozen eggs in order to give birth to her own grandchild.
Last year the High Court in London denied a request for a 59-year-old mother to use her dead daughter's frozen eggs however this Thursday the controversial decision was overturned in the Court of Appeals making it more of a possibility.
The daughter, who was known in court as ‘A’ passed away in 2011 at the tender age of 28 after being diagnosed with bowel cancer. According to the family, it was the daughter’s final wish to freeze her eggs so that her parents could carry and raise her baby.
The case, which was the first of its kind in Britain initially ruled against the mother, known only as ‘Mrs M’ on the basis that there was not sufficient evidence to prove that the daughter had given full consent.
However, this ruling was overturned on Thursday after a lengthy appeal process which means that The Human Fertilisation and Embryology Authority (HFEA) must now reopen the case and consider granting the mother access to her daughter's frozen eggs.
Throughout the 5-year legal battle, 'Mrs M' has been adamant that it was her daughters wish to have them birth and parent her child, she said
“It was clear [her daughter] wanted her genes to be carried forward after her death."
Mrs M told the court that before dying her daughter had told her
“I want you and dad to bring them up, they will be safe with you”
Mrs M also said that her daughter had told her
“I didn’t go through IVF to save my eggs for nothing”
If the decision is reversed and the HFEA decide to provide Mrs M with her dead daughter's frozen eggs, she plans to travel to New York to seek IVF treatment using donor sperm.
