Policeman gets jail sentence for removing condom during sex without girlfriend’s knowledge

A policeman has received a suspended jail sentence for removing a condom during sex without his girlfriend’s knowledge.

The act, known as ‘stealthing’, involves taking off a condom without a partner’s consent and continuing to have sex with them.

The German victim said that she noticed what had happened after the man ejaculated inside of her.

She then left the premises and contacted police.

CNN reports that the man received a suspended eight-month jail sentence for sexual assault. He was also fined €3,000 and ordered to pay €96 for a sexual health test for the woman.

The police officer was not charged with rape because the woman had consented to have sex with him using a condom. She said that she had “explicitly requested” that he wear one.

The man claimed that he removed the condom because it had broken. He also denied that he had ejaculated inside of the woman.

The landmark case is the first time that a person has been found guilty of ‘stealthing’ in Germany, but similar cases have been taken (and won) in Switzerland and Canada.

Berlin’s chief court spokeswoman, Lisa Jani, said that the police officer was tried for rape but found guilty of sexual assault.

The act of ‘stealthing’ was deemed non-consensual, with the sex itself being seen as consensual by the court.

Jani said that the issue of removing a condom during sex without consent remains a “grey area” in German law.
