Irish nanny Aisling Brady McCarthy has been charged with first-degree murder, assault and battery following the death of a child in her care in January.
The 34-year-old from Massachusetts, originally from Cavan, was minding one-year-old Rehma Sabir at the time.
She previously pleaded not guilty to the charge of assault and battery, but now prosecutors have publicly stated what they believe is the exact cause of the baby’s death for the first time, Irish Times reports.
This means that the grand jury believe the prosecutor has a strong enough murder case against Brady McCarthy to go to trial.
A lawyer for the childminder has repeatedly said that Brady McCarthy has been wrongfully accused of harming the child. Lawyer Melinda Thompson asked the court last month how the prosecutors are determining the child died. The autopsy report was still being written at that stage and so no exact answer was given.
Aisling Brady McCarthy has been living illegally in the States since 2002. She was arrested after police found the child unresponsive with head injuries at an apartment on January 14th.
The child was brought to hospital where it was discovered she was suffering from subdural and retinal haemorrhaging and cerebral swelling.
She died in hospital two days later.
Prosecutors maintain that Ms Brady McCarthy was alone with the child when the fatal injuries occurred.
“It is alleged that on January 14th, the child was in the care of the defendant, her nanny,” the prosecutors said in the statement.
“Through their investigation, including interviews with witnesses, police concluded that the defendant had sole custody of and contact with the child during the time that the child sustained the abusive head trauma injuries that caused her death.”
