Man Jailed For Sexual Assault After Piercing Girlfriend’s Condoms Has Appeal Rejected

Craig Jaret Hutchinson decided to hatch an elaborate plan to prevent his girlfriend from breaking up with him after she threatened to leave.

The Canadian man impregnated his girlfriend after piercing holes in her condoms and was sentenced to an 18-month jail term in December 2011.

Hutchinson made an attempt to appeal his charge but had his sexual assault conviction upheld.

According to Sky News, the woman, whose identity has been protected, received a number of text messages from Hutchinson in the weeks that followed revealing what he had done.

The case made its way to the Supreme Court of Canada, however today judges unanimously rejected Hutchinson’s appeal and ruled that he had deprived the woman of her ability to consent to sex.

The ruling reads: “By any definition, when someone uses a condom, it is part of the sexual activity. It is therefore part of what is or is not consented to.”

“When individuals agree to sexual activity with a condom, they mean an intact condom. They are not merely agreeing to a sexual activity, they are agreeing to how it should take place.”

Along with the prison sentence for the incident, which occurred back in 2006, Hutchinson will also be placed on the sex offender register.
