Ray D’Arcy has spoken out and blasted the Irish State for not legislating on issues surrounding IVF treatment, after he learned that a woman will not be able to use her dead husband’s sperm to get pregnant.
Speaking about the issue, the Today FM host said that the “law is an ass” after one of his listeners rang in and told Ray that she was informed her dead husband’s sperm would be destroyed this week.
The sperm had been stored at a hospital in Dublin ever since her husband had been diagnosed with cancer back in 2010.
“As a country we are operating in a legal vacuum and I can say with certainty that if there were laws around this area this woman wouldn’t be in this situation that she is in now,” said Ray.
“To me, I don’t think that it is fair at all. This woman wants to have a child with a man she loved, a man she married. I think on this occasion the law is an ass,” he added.

Following the woman’s appearance on the Ray D’Arcy Show, the station was flooded with calls from solicitors who were eager to represent the woman if she chose to take her problem further.
It’s definitely a sad story and one that could have been avoided if proper legislation was put in place. We hope this woman gets the outcome that she deserves for herself and for her late husband.
