It has been reported by TMZ that he fell from a third story hotel room in Buenos Aires.
Emergency services are said to be in attendance with a red tent erected at the scene.
The musician was best known around the world as a member of One Direction, formed in 2010 by Simon Cowell on X Factor.
He was reportedly in Argentina earlier this month for the gig of his former bandmate Niall Horan.
Payne had a son with Girls Aloud star Cheryl Cole.
Sky News have reported that 'someone appeared to be under the influence of drugs or alcohol' before falling from a balcony.
Just hours before his tragic death, Payne posted several photos and videos to social media.
In posts shared within the hour of local news reporting his death, Payne appeared to share images of himself about to play polo.
He also filmed his girlfriend, revealing in the video that they were staying a friend's house.
In another video, he spoke about enjoying a coffee in Argentina.
In one of the videos he says: "Morning everybody. Here's a little video of me. It's rude to put hats on tables. Is this your hat? Children. It's a lovely day here in Argentina. This is the breakfast table. Just enjoying a coffee and breakfast even thought it's 1pm."
