Making A Murderer’s Steven Avery granted appeal over murder conviction

Making A Murderer‘s Steven Avery has been granted the right to appeal his murder conviction.

The Wisconsin man, who was the subject of two series of the hugely popular true crime Netflix series, is currently serving a life sentence for the murder of photographer Teresa Halbach.

Before he was charged with Halbach’s murder, Avery was imprisoned for 18 years for a rape and attempted murder he did not commit.

He has always maintained his innocence.

Avery was granted the right to an appeal this week over possible human remains that have been found in a gravel pit away from the Avery property.

Lawyer Kathleen Zellner said that the bones were given to the Halbach family which prevented the remains from being tested for DNA.

Zellner is arguing that if the remains found in the gravel pit belong to Halbach this proves that she was not murdered on the Avery property as previous stated.

“This evidence has the potential to undo the whole case,” she told Newsweek.

“The case is being remanded back to the circuit court to conduct proceedings, which can include a hearing.

“The circuit court can grant a new trial, or if not, back to appellate court who can reverse the conviction and/or grant a new trial.”

This ruling means that evidence relating to the bones can now be submitted.

Zellner took to Twitter last night to share a series of celebratory messages including “The DREAM LIVES ON for Steven Avery to be FREE AGAIN” and “We are going to have an extraordinary number of constitutional violations when we are done.”

Avery’s nephew Brendan Dassey was also sentenced to life in prison for the murder of Halbach.

He claims he was coerced into confessing to the murder and maintains his innocence.
